These Terms of Service ("Terms") constitute a legally binding agreement between you ("User", "you", or "your") and Buzzin.AI ("Company", "we", "us", or "our") governing your use of Buzzin Content Studio (the "Service"). By purchasing, installing, or using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.

1. Description of Service

Buzzin Content Studio is a WordPress plugin that uses artificial intelligence to assist with content generation, including blog post topics, outlines, full drafts, content rewrites, and SEO metadata. The Service:

  • Requires an active, valid license purchased from Buzzin.AI
  • Requires an active internet connection to function
  • Utilizes third-party AI services (OpenAI and Anthropic) to generate content
  • Saves all generated content as Draft posts in WordPress for user review before publishing

2. License Grant and Restrictions

2.1 License Grant

Upon valid purchase, Buzzin.AI grants you a limited, non-exclusive, non-transferable, revocable license to use the Service subject to these Terms and your selected plan:

  • Starter License: Use on 1 WordPress domain with 75 AI Credits per month (includes AI-powered web research)
  • Pro License: Use on up to 5 WordPress domains with 200 AI Credits per month (includes AI-powered web research)

2.2 License Restrictions

You may NOT:

  • Share, resell, redistribute, sublicense, or transfer your license key to third parties
  • Use a single license on more domains than permitted by your plan
  • Circumvent, disable, or interfere with license validation or usage tracking
  • Reverse engineer, decompile, or disassemble the Service
  • Remove or alter any proprietary notices, labels, or marks
  • Use the Service for any unlawful purpose or in violation of these Terms
  • Use automated tools to abuse the Service or circumvent usage limits

2.3 Domain Binding

Licenses are bound to specific domain(s) upon activation. You may deactivate and reactivate your license on different domains through your account, subject to reasonable frequency limits to prevent abuse.

3. AI-Generated Content

3.1 Nature of AI Content

The Service uses artificial intelligence to generate content based on your inputs. You acknowledge and understand that:

  • AI-generated content is created algorithmically and may contain errors, inaccuracies, or inappropriate material
  • AI does not have human judgment, fact-checking capabilities, or real-time knowledge
  • Output quality varies based on inputs, prompts, and inherent AI limitations
  • No AI system is perfect, and unexpected or undesirable outputs may occur

3.2 Content Ownership

Subject to applicable law and the rights of third parties, you retain ownership of content you create using the Service. The AI-generated text produced becomes yours to use, edit, and publish. However, similar content may be generated for other users who provide similar inputs.

3.3 Draft-First Design

All AI-generated content is intentionally saved as a Draft in WordPress. This design ensures that no AI content is ever published automatically. You must explicitly review and choose to publish any content. This is a fundamental safety feature of the Service.

3.4 Research and Citation Features

The Service includes features designed to improve citation accuracy, but these are not guarantees:

  • Quote Extraction: The Service extracts quotes and statistics from web sources and provides them to AI models to help ground generated content in source material
  • Citation Verification: The Service uses AI-based verification prompts to check citations against source material and may remove citations that cannot be verified
  • No Guarantee of Accuracy: These systems use AI technology and are not perfect. AI language models may:
    • Misinterpret source material
    • Generate plausible-sounding but incorrect citations
    • Miss context or nuance in source documents
    • Fail to detect subtle inaccuracies
  • Your Verification Responsibility: You must independently verify all facts, statistics, and citations before publishing. The Service's verification features are aids, not substitutes for human review
  • Source Availability: Web sources may change, be removed, or become unavailable after content generation

IMPORTANT: While we strive to provide accurate citation features, AI technology is not a hard science. We design prompts and provide source material with the goal of accuracy, but we cannot guarantee that AI-generated content will be factually correct or that citations will be accurate. You bear full responsibility for verifying and publishing content.

3.5 YOUR PUBLISHING RESPONSIBILITY

THIS IS A CRITICAL PROVISION. PLEASE READ CAREFULLY.

BUZZIN.AI IS NOT RESPONSIBLE FOR ANY CONTENT THAT YOU PUBLISH ON YOUR WEBSITE. The decision to publish any content—whether AI-generated, AI-assisted, or otherwise—is solely yours as the WordPress administrator. By using this Service, you expressly acknowledge and agree that:

  • You have sole and exclusive responsibility for reviewing all AI-generated content before publishing
  • You must verify accuracy — AI can produce factually incorrect, outdated, or misleading information. You must fact-check all claims, statistics, and citations before publishing
  • You must ensure legal compliance — Content must comply with all applicable laws, including defamation, copyright, privacy, advertising regulations, election laws, and hate speech laws
  • You must ensure ethical standards — You are responsible for ensuring content meets ethical standards and does not spread misinformation, disinformation, or harmful content
  • You must ensure appropriateness — Content must be suitable for your audience and meet your quality standards
  • You bear all consequences of publishing AI-generated content, including any legal liability, reputational harm, regulatory penalties, or other damages
  • The publish button is your final approval — Once you click publish, the content and all its consequences are entirely your responsibility
  • Draft mode is for your protection — All AI-generated content is intentionally saved as Draft (never published automatically) to give you the opportunity to review, edit, fact-check, and approve before publication. This is your safeguard.

We provide tools such as required words, forbidden words, brand voice settings, and allowed entity names to help guide AI outputs toward your preferences. However, these are aids, not guarantees. No configuration can ensure perfect AI output. You must thoroughly review all generated content before publishing.

As the WordPress site administrator, you are the publisher. Just as a newspaper editor is responsible for what appears in print, you are responsible for what appears on your website—regardless of whether it was written by humans, AI, or any other tool.

3.6 Prohibited Content and Uses

You agree NOT to use the Service to generate, create, publish, or distribute content that:

Illegal Content

  • Violates any applicable federal, state, local, or international law or regulation
  • Promotes, facilitates, or provides instructions for illegal activities
  • Infringes on intellectual property rights, copyrights, trademarks, or patents of others
  • Violates privacy rights or publicly discloses private information without consent
  • Constitutes fraud, identity theft, or financial scam content
  • Violates election laws, campaign finance regulations, or voter suppression laws

Harmful & Dangerous Content

  • Promotes or incites violence, terrorism, or physical harm to any person or group
  • Contains explicit threats, harassment, stalking, or intimidation
  • Promotes self-harm, suicide, or eating disorders
  • Provides instructions for creating weapons, explosives, or dangerous substances
  • Promotes or facilitates human trafficking, exploitation, or abuse

Hate Speech & Discrimination

  • Promotes hate speech, discrimination, or prejudice based on race, ethnicity, national origin, religion, gender, sexual orientation, disability, age, or any other protected characteristic
  • Demeans, dehumanizes, or incites hatred against individuals or groups
  • Advocates for the denial of civil rights or freedoms of any group
  • Contains slurs, epithets, or derogatory language targeting protected groups

Misinformation & Disinformation

  • Deliberately spreads false information (disinformation) or recklessly spreads unverified claims (misinformation)
  • Contains fabricated "facts," statistics, or citations with intent to deceive
  • Impersonates real individuals, organizations, or government entities without authorization
  • Spreads demonstrably false health information that could cause physical harm
  • Deliberately manipulates or fabricates media (deepfakes, misleading edits) to deceive
  • Spreads election misinformation or voter suppression content
  • Makes false claims about election results, voting processes, or candidates

Deceptive & Manipulative Content

  • Spam, clickbait, or content designed primarily to manipulate search rankings
  • Phishing, malware distribution, or content designed to compromise security
  • Deceptive advertising, false testimonials, or fraudulent product claims
  • Astroturfing, fake reviews, or coordinated inauthentic behavior
  • Content designed to manipulate financial markets or securities prices

Sexual & Exploitative Content

  • Sexually explicit content, pornography, or adult content
  • Content sexualizing or exploiting minors in any way
  • Non-consensual intimate imagery or "revenge porn"
  • Content promoting or facilitating prostitution or sex trafficking

Platform Policy Violations

  • Content that violates OpenAI's Usage Policies
  • Content that violates Anthropic's Acceptable Use Policy
  • Content that violates WordPress.org Plugin Directory Guidelines (if applicable)

Enforcement: We reserve the right to immediately terminate licenses used in violation of these restrictions without refund or prior notice. We may report illegal activity to law enforcement authorities. We are not obligated to monitor user content, but we may investigate reported violations.

Reporting Violations: If you become aware of content generated using our Service that violates these restrictions, please report it to abuse@buzzin.ai.

4. Payment, Billing, and Refunds

4.1 Payment Processing

Payments are processed by Stripe. By purchasing, you agree to Stripe's terms of service. We do not store your complete payment card information.

4.2 Subscription Terms

Licenses are sold as monthly subscriptions that automatically renew unless cancelled. You may cancel at any time through your account dashboard. Cancellation takes effect at the end of your current billing period.

4.3 Refund Policy

We offer a 14-day money-back guarantee. If you are not satisfied with the Service within 14 days of your initial purchase, contact us for a full refund. Refunds are not available after 14 days, for renewals, or for accounts terminated due to Terms violations.

4.4 Price Changes

We may change pricing with 30 days notice. Price changes apply to subsequent billing periods, not current subscriptions.

5. Usage Limits and Fair Use

5.1 Monthly Generation Limits

Your plan includes a monthly limit on AI Credits. When you reach your limit, generation features pause until your next billing cycle. Generation counts reset on your billing renewal date.

5.2 No Rollover

Unused AI Credits do not roll over to subsequent months.

5.3 Fair Use

We reserve the right to enforce fair use policies and take action against accounts exhibiting abusive patterns, including but not limited to automated abuse, circumvention of limits, or use patterns indicating license sharing.

6. Service Availability and Support

6.1 Availability

We strive for high availability but do not guarantee uninterrupted, error-free service. The Service depends on:

  • Our own infrastructure and servers
  • Third-party AI providers (OpenAI and Anthropic)
  • Internet connectivity
  • WordPress and your hosting environment

We are not liable for outages, slowdowns, or failures caused by any of these factors or by circumstances beyond our reasonable control.

6.2 Maintenance

We may perform maintenance that temporarily affects Service availability. We will attempt to provide advance notice for planned maintenance when possible.

6.3 Support

Support is provided via email. Pro plan users receive priority support. We aim to respond within 1-2 business days but do not guarantee response times.

7. Intellectual Property

7.1 Our Intellectual Property

The Service, including its code, design, features, documentation, and branding, is owned by Buzzin.AI and protected by intellectual property laws. Your license grants usage rights only; no ownership or other rights are transferred.

7.2 Feedback

If you provide feedback, suggestions, or ideas about the Service, you grant us a perpetual, royalty-free license to use such feedback for any purpose without compensation or attribution.

8. Disclaimers and Limitation of Liability

8.1 Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. TO THE MAXIMUM EXTENT PERMITTED BY LAW, BUZZIN.AI DISCLAIMS ALL WARRANTIES, INCLUDING BUT NOT LIMITED TO:

  • IMPLIED WARRANTIES OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE
  • WARRANTIES OF NON-INFRINGEMENT
  • WARRANTIES REGARDING THE ACCURACY, RELIABILITY, OR QUALITY OF AI-GENERATED CONTENT
  • WARRANTIES THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE
  • WARRANTIES REGARDING RESULTS OBTAINED FROM USING THE SERVICE

8.2 Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW:

  • BUZZIN.AI SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, REVENUE, DATA, GOODWILL, OR OTHER INTANGIBLE LOSSES
  • BUZZIN.AI SHALL NOT BE LIABLE FOR ANY DAMAGES ARISING FROM AI-GENERATED CONTENT, INCLUDING ITS PUBLICATION, USE, OR RELIANCE UPON IT
  • BUZZIN.AI SHALL NOT BE LIABLE FOR THIRD-PARTY CLAIMS ARISING FROM YOUR USE OF THE SERVICE OR CONTENT YOU PUBLISH
  • OUR TOTAL AGGREGATE LIABILITY FOR ALL CLAIMS ARISING FROM OR RELATED TO THE SERVICE SHALL NOT EXCEED THE TOTAL AMOUNT YOU PAID TO US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM

SOME JURISDICTIONS DO NOT ALLOW LIMITATION OF CERTAIN DAMAGES. IN SUCH JURISDICTIONS, OUR LIABILITY IS LIMITED TO THE MAXIMUM EXTENT PERMITTED BY LAW.

8.3 Essential Purpose

THE LIMITATIONS IN THIS SECTION APPLY EVEN IF ANY LIMITED REMEDY FAILS OF ITS ESSENTIAL PURPOSE.

9. Indemnification

You agree to indemnify, defend, and hold harmless Buzzin.AI, its officers, directors, employees, contractors, agents, licensors, and affiliates from and against any and all claims, damages, obligations, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising from:

  • Your use of the Service
  • Content you generate, publish, or distribute using the Service
  • Your violation of these Terms
  • Your violation of any applicable law or third-party rights
  • Any claim by a third party related to content you published

10. Termination

10.1 Termination by You

You may cancel your subscription at any time. Your access continues until the end of your current billing period.

10.2 Termination by Us

We may suspend or terminate your license immediately, without notice, for:

  • Violation of these Terms
  • Fraudulent, abusive, or illegal activity
  • Non-payment
  • Upon request by law enforcement or government authority

10.3 Effect of Termination

Upon termination, your right to use the Service ends immediately. Content previously generated and saved in your WordPress remains in your WordPress installation. Provisions that by their nature should survive termination will survive, including ownership, warranty disclaimers, indemnification, and limitation of liability.

11. Modifications to Service and Terms

We reserve the right to modify, suspend, or discontinue the Service (or any part) at any time. We may also modify these Terms at any time. For material changes, we will provide notice via email or prominent posting on our website. Continued use of the Service after changes take effect constitutes acceptance of the modified Terms.

12. Governing Law and Disputes

12.1 Governing Law

These Terms are governed by and construed in accordance with the laws of the State of Delaware, United States, without regard to its conflict of law provisions.

12.2 Dispute Resolution

Any dispute arising from these Terms or the Service shall first be attempted to be resolved through good-faith negotiation. If negotiation fails, disputes shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association, except that either party may seek injunctive relief in any court of competent jurisdiction.

12.3 Class Action Waiver

TO THE EXTENT PERMITTED BY LAW, YOU AGREE THAT ANY DISPUTE RESOLUTION PROCEEDINGS WILL BE CONDUCTED ONLY ON AN INDIVIDUAL BASIS AND NOT IN A CLASS, CONSOLIDATED, OR REPRESENTATIVE ACTION.

13. General Provisions

13.1 Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Buzzin.AI regarding the Service.

13.2 Severability

If any provision of these Terms is found unenforceable, the remaining provisions remain in full force and effect.

13.3 Waiver

Failure to enforce any provision of these Terms does not constitute a waiver of that provision or any other provision.

13.4 Assignment

You may not assign these Terms or your rights under them. We may assign our rights and obligations without restriction.

13.5 Force Majeure

We are not liable for delays or failures in performance resulting from circumstances beyond our reasonable control, including natural disasters, war, terrorism, labor disputes, government actions, or internet/infrastructure failures.
